Eligibility, Finalist and Contestant Selection for Beg, Borrow and Deal
The following are the eligibility criteria and Finalist selection procedures for a potential new undertaking of the reality game show, "Beg, Borrow and Deal." These criteria and procedures are subject to change with or without notice at the sole discretion of Producer. Official Rules, including criteria and procedures for selection of Contestants, for this new undertaking have not yet been formulated and may differ from those used in the original version of Beg, Borrow and Deal.

ELIGIBILITY:

The applicants must sign statements acknowledging that they have read, understood and will comply with all of the following eligibility requirements for "Beg, Borrow and Deal":

A. Employees, officers, directors and agents of ESPN, Inc., ABC, Inc., The Walt Disney Company, the Hearst Corporation, Broken Twig Productions, Inc. ("Producer") and/or of any of their respective licensees, assigns, parents, affiliated and subsidiary companies and the immediate family (spouse, mother, father, sister, brother, daughter or son, regardless of where they live) or members of the same households (whether related or not) of such employees, officers, directors and agents are not eligible to be Contestants on "Beg, Borrow and Deal" or participate in this application process. In addition, any person closely acquainted with any person connected with the production or administration of the Program is not eligible, if in the Producer's sole discretion, the person's participation could create the appearance of impropriety. As used herein, the term "Program" refers to a television program or programs based on the Beg, Borrow and Deal competition.

B. Applicants may not presently be a legally qualified candidate for any type of political office ("Candidate") and may not become a Candidate from the time the application is submitted until one (1) year after telecast of the final episode of the Program in which the applicant appears.

C. All applicants must have a driver's license issued by one of the 50 United States valid through the end of July 2003, automobile liability insurance covering applicant's use of non-owned motor vehicles and health insurance.

D. All applicants must be at least 21 years of age at the time of application.

E. Applicants must never have been charged with a felony or misdemeanor, other than minor traffic violations. Applicants must never have had a restraining order entered against them.

F. All applicants must be United States citizens and be living in the United States.

G. All applicants must be in good physical and mental health, and must be aware and sign releases attesting to the fact that the activities in the Program may involve risks and hazards, and that participating in the Program may expose applicant and other participants to the risk of death, serious injury, and property damage caused by the nature of the Program itself, the instruction by Producer, acts, omissions, recommendations or advice given by the Producer, ESPN, or their agents, employees, or other persons or entities concerning the Program; latent or apparent defects or conditions in any equipment used in the Program; the use or operation by applicant or others of said equipment; negligent or intentional acts of other people, including but not limited to other Contestants; weather or other natural conditions; the nature of travel including but not limited to latent defects, weather conditions, and human error; applicant's physical condition; applicant's own acts or omissions; first-aid, medical or emergency treatment or other services rendered to applicant or others; and/or consumption of food or drink. Applicants must understand and acknowledge that the above list of risks is not complete or exhaustive. Applicants must accept and assume all risks of, and release Producer, ESPN, and their parents, subsidiaries, related entities and their respective agents and employees, and other persons or entities connected with the Program from any liability for, death, injury, illness or disease, or other damage to themselves, to others, or to their property arising in any way from their participation in this Program.

H. Any applicant who has appeared on any national broadcast or cable network primetime television reality/game show (e.g., Survivor, Big Brother, Fear Factor, Who Wants To Be A Millionaire, Greed, 21, Winning Lines, The Weakest Link, Bands on the Run, Blind Date, Boot Camp, Chains of Love, Eco-Challenge, Love Cruise, Making The Band, The Mole, Murder in Small Town X, Popstars, The Real World, Road Rules, Spy TV, Temptation Island, Ultimate Reality, Wanted, Who Wants To Marry A Multi-Millionaire, WWF Tough Enough, You Don't Know Jack, etc.; thus, appearances on non-primetime programs such as Jeopardy, Wheel of Fortune, Hollywood Squares, Family Feud, etc. are not prohibited) that (i) has been telecast during primetime within one (1) year prior to the application date or (ii) is intended to be telecast during primetime within one (1) year after the application date is not eligible.

I. All applicants who are selected as Finalists must be available to travel to a location in the United States to be determined by Producer for approximately 4 days in or about March 2003 for further interviews and qualification procedures. All dates, as well as the Contestant selection procedures employed in the first undertaking of Beg, Borrow and Deal, are subject to change at Producer's sole discretion.

J. All Finalists must complete and timely return the "Finalist Package," which will include, among other things, a Medical History Form, Medical Authorization, Name and Likeness Agreement, Release Forms and Waivers for Finalists and their family members, Medical Release Form, Release of Records Form, Questionnaire, Confidentiality Agreement, General Release and Indemnity Agreement, and any other authorizations, release forms and waivers as Producer may require (all forms will be furnished to the Finalists). In the Release Forms and Waivers, the Finalist agrees, among other things, to assume the risk of, and release Producer, ESPN, and their parents, subsidiaries, related entities and their respective agents and employees, and other persons or entities connected with the Program from any claim or liability for, any and all injury, illness, damage, loss, or harm to Finalist and Finalist's property, howsoever caused, resulting from or arising out of the selection of Contestants, Contestant's participation in the Program, and/or the production and/or exploitation of the Program.

K. All Finalists will be required to undergo physical and psychological examinations and testing (to be conducted in a location in the United States to be determined by Producer by trained personnel selected by the Producer) and meet all physical and psychological requirements, as set by Producer in its sole discretion.

L. All Finalists must authorize Producer to conduct a background check including, in Producer's sole discretion and without limitation, checks of employment history, driving record, criminal background, civil litigation and/or a credit check.

M. Upon Producer's request, all Contestants agree to sign any additional releases or authorizations that Producer in its sole discretion deems necessary.

N. Finalists shall treat all information and material received or acquired during participation in the Contestant selection process and Program, including without limitation, selection process, locations, tests, procedures, questions, materials, identity of other Finalists and Contestants as strictly confidential and shall not disclose any such information to any third party.

O. All Contestants selected must be available to travel and participate in "Beg, Borrow and Deal" for approximately six (6) consecutive weeks during March and April 2003. All dates are subject to change at Producer's sole discretion. Contestants will also agree to make a reasonable number of personal appearances and engage in other reasonable publicity activities on behalf of ESPN and affiliated entities, for which they will be reimbursed for reasonable and necessary travel, lodging and food, but will not otherwise receive any remuneration or consideration. All Contestants must agree to live, work, travel, participate as part of the competition in tasks ("Tasks") and cooperate with the other Contestants on his or her team and the Producer prior to, during and for a reasonable period after the conduct of the Game. Contestants acknowledge that, except as specifically described below, they will be provided with no resources to accomplish the Tasks, to travel from the point of origin to the locations of the Tasks and to the location of final Task count and to otherwise participate in the Program. Thus, each Contestant must be able to travel for long periods of time under unpredictable and physically and mentally taxing conditions, must be adaptable to various living and working situations, and must enjoy working and living in close proximity with others of varied age, sex, race, background, and experience. Contestants are subject to search by Producer at any time for any reason including for illegal or inappropriate items and ESPN Standards and Practices purposes. All actions of Finalists and Contestants - including those that might be regarded as private - may be videotaped or otherwise recorded on a 24-hour per day, seven-day per week, basis throughout the application process and the Game.

Q. All Contestants must abide by all applicable laws. Without limiting the generality of the foregoing, the following are not permitted: hitch-hiking; speeding or reckless driving; pan-handling in an aggressive or harassing manner or otherwise in violation of any law; trespassing; bribery; use or possession of illegal substances or weapons, assault or harassment, or acceptance of wages without proper withholding and completion of all necessary employment documentation. Contestants must wear seatbelts when traveling by car, bus or truck. Violation of any applicable law is grounds for immediate disqualification from the Program. Disqualification of a Contestant for any reason will not void or otherwise affect any of the releases, waivers and other agreements previously executed by any such Contestant, and Producer and ESPN may continue to rely upon and enforce any of such releases, waivers and other agreements.

HOW TO ENTER:

A. Only one (1) application per person. Applicants must meet all Eligibility Requirements and may apply as follows:

(1) Complete the Application Form (including the Contestant Questionnaire and signed Name and Likeness Release). The application is available for download at espn.com or by mailing a written request for an application (include your name and address) to: ATTN: Beg, Borrow and Deal. Application Request, Broken Twig Productions, 7060 Hollywood Blvd, Suite 1205, Hollywood, CA 90028. Applications MUST be written clearly or typed.

(2) Record a videotape of yourself, which meets the following restrictions:

(a) LENGTH: Up to FIVE MINUTES. Anything over five minutes will not be considered. ii. FORMAT: VHS OR MINI-DV ONLY. iii. CONTENT: Who are you and why would you be a good Contestant on "Beg, Borrow and Deal"? iv. LABEL: The videotape must be labeled clearly with your name, address, age, e-mail address, and all of your phone numbers. v. The videotape becomes the sole property of Producer and will not be returned to you, whether or not you are selected as a Contestant, and may be used by Producer in any manner in any media.

c. Include a small photo of yourself.

d. Mail the Application Form (including Contestant Questionnaire, signed Name and Likeness Release), labeled videotape, and photo to the following address:

e. The Producer reserves the right to close the application process at any time with or without notice.

B. Producer reserves the right to make additions to and/or deletions from the application process above. Producer also reserves the right to contact applicants to ask additional questions and/or conduct phone interviews to gather additional information about applicants. Such phone interviews are at the Producer's sole discretion to assist in gathering information for Contestant selection . Producer may record any or all of such conversations and such recordings become the sole property of Producer and, whether or not you are selected as a Contestant, may be used by Producer in any manner in any media.

C. Producer is not responsible for lost, stolen, or incorrectly mailed applications. Due to the high volume of applications Producer is anticipating, Producer will not be able to answer any questions about the receipt or status of any application or videotape. All applications and application materials become the sole property of Producer.

CONTESTANT SELECTION:

Procedures and criteria for Contestant selection, including, without limitation, the number of Finalists, travel requirements for Finalists and selection of alternates, have not yet been formulated, and may or may not be different from those used in connection with the first undertaking of Beg, Borrow and Deal.Selection of Finalists and Contestants shall be made by Producer based on such criteria as Producer shall determine, which may be subjective. Producer is selecting Finalists and Contestants that it determines in its sole discretion to be, among other things, outgoing, adventurous, clever and resourceful, physically and mentally fit, and to have interesting and diverse life styles and personalities. Producer is not obligated to select someone, even if he or she meets all eligibility requirements and all criteria for selection. Producer's decision regarding the selection of Finalists and Contestants is final and not subject to challenge or appeal. Producer is not obligated to have any Contestant appear on the Program and Producer shall have the right at all times and in its sole discretion to remove or replace any Contestant in connection with the Program for any reason or no reason. Even if a Contestant participates on the Program or any part thereof, Producer is not obligated to telecast or otherwise use or exploit the Program or any part thereof. If a Finalist is not selected as a Contestant, or if a Contestant quits or is disqualified for any reason, this will not void or otherwise affect any of the releases, waivers and other agreements previously executed by any such Finalist or Contestant, and Producer and ESPN may continue to rely upon and enforce any of such releases, waivers and other agreements. By entering, each applicant agrees to release, discharge and hold harmless the Producer from all claims and damages arising out of his/her participation in the Program, and to authorize the use of his/her name, voice and likeness used at Producer's discretion as part of the Program, or as part of promotions for the Program in perpetuity, in any and all media now known or hereafter devised. Finalists will sign releases to this effect.
