An employee who is injured or ill may not be limited to sick leave, vacation, or personal leave if he or she needs time off. There are many other types of leave that an employer may be required to provide. For example, if the employee has a newborn or newly adopted child, or the employee or his or her family member has a serious health condition, the employee may be entitled to up to twelve weeks of unpaid leave per year under the Family and Medical Leave Act (FMLA). A serious health condition is an illness or injury requiring inpatient medical treatment or continuing outpatient treatment by a health care provider, or a chronic medical condition. Furthermore, many states have enacted their own family and medical leave statutes, some of which require employers to provide additional leave or paid leave. Medical leave may also be an appropriate accommodation of a disability under the Americans with Disabilities Act (ADA). The ADA does not specify whether or what type of leave must be given to an employee who is disabled by an illness or injury, but courts have held that an employer may be required to provide leave beyond sick leave or personal leave if such leave would be a reasonable accommodation of a disability, as long as the leave is not unduly burdensome to an employer. Deployed to Operation Iraqi Freedom in 2005, Sgt. Major was assigned to LSA Anaconda Base in Bilad, Iraq, a place of persistent enemy attack. Sixteen days after being promoted to his current rank in 2006, Acosta was hit by enemy fire. A mortar cost him his eyesight and other significant sensory deprivations. It is said that, while severely wounded, he was still giving orders and caring for the warriors with whom he was serving, thinking first of them. Rehabilitation efforts ensued. Acosta's tenacity and courage carried him through the darkest of days. Though he still faces challenges, he has since gone on to serve as a motivational speaker, an advocate for the disabledmost especially disabled warriorsand successfully championed legislation for the blind. October 2010 found him at the White House with the President for the signing of HR 3101. Today, Sgt. Major is a fervent advocate for wounded warriors and the many challenges they face and resides in the LA area. He has committed his life in service to other Vets. He knows their challenges well. In May of 2004, Erick was medically retired from the Army and was able to keep his rank of Sergeant. By the fall he went back to school to get his degree. He graduated from Arizona State University with a Math degree. By 2009 he moved back to Southern California to work for a small telecommunications company. Now, Erick is working on his MBA and starting a new company to help other Veterans. In addition to being a full-time mom, she operates the nonprofit Chosen to be Loved, which distributes Life Booksbooks that "allow special moments and development stages in the life of a child to be captured on paper so that they can be kept forever." Robbin and her husband, David, have been foster parents for over ten years. They have seven children, five of which are adopted out of the foster care system. As children came into their home, Robbin became concerned over the lack of family pictures and/or records that should accompany each one. Not only did this make for a much more difficult transition, these children, who need desperately to be able to look back into their past, came without any memories written down or pictures to see what they looked like. Some states mandate that a life book be kept for each child, but this was obviously not being done. Inspired, Robbin researched and dedicated her time, incorporating her personal experience, to create a simple, yet thorough book to aid foster parents, foster children and social workers. This wonderful tool helps each family make a smooth and more meaningful transition, while holding each child's history. AIR DATE May 8, 2011- Tracie Kimbrough, Making Strides Against Cancer:Tracie speaks with LaFern Cusack about being a cancer survivor and the 2011 Making Strides Against Breast Cancer San Fernando Valley Saturday, June 11th. Tracie's two aunts and their maternal grandmother battled the disease and one aunt had passed. When Tracie was diagnosed with in situ breast cancer (cancer that has not spread to surrounding tissue) in 2007 her mother was with her when she went under for surgeries. "How she did it I'm not sure," Tracie said. "Watching my mom, who's the strongest woman I know, go through this was unbelievable. She had to face watching both her daughters face cancer after losing a sister to breast cancer." Following a double mastectomy Tracie underwent breast reconstruction but as the mother of an adult daughter, Tracie's first reaction to her own diagnosis was "Oh, no, not my daughter. If it needs to be me then let it be me, but not my daughter," she said. "I've been a mother since I was 19. I really don't know how to be anything but a mom." Because she is at elevated risk for breast cancer, Tracie's daughter Alyceia, now 28, began having regular mammograms at a younger age than the American Cancer Society's recommended age 40, and does regular breast self-examinations. Having witnessed Tracie's determination and positive attitude the reconstructive surgeon's nurse suggested she volunteer for the American Cancer Society's Reach To Recovery program, a free peer visitation program for women newly diagnosed with breast cancer. After realizing many people didn't have the support system she trained for the program.
